1. About these terms

These terms govern your use of PriceCheckMD (the "site"). By using the site, you agree to them. If you don't agree, please don't use the site.

2. The service

PriceCheckMD lets you search a database of negotiated healthcare prices that insurers and hospitals are required by federal law to publish in machine-readable form. The site is currently free to use and does not require an account. We may add additional services for businesses or researchers in the future, but core search is intended to remain free.

3. The data: important limits

This is the most important section. Negotiated rates are not personal price quotes.

• What we show is what an insurer agreed to pay a provider for a given procedure, based on data those parties published themselves. It is not a quote of what you personally will be charged.
• What you actually pay depends on your specific plan, deductible, copay, coinsurance, whether you've met your out-of-pocket maximum, whether the provider is in-network, whether modifiers or additional services apply, and other factors we cannot see from the published files.
• Data may be incomplete, delayed, or contain errors. Federal transparency files are large, frequently updated, and have known quality issues. Procedures may be missing, prices may be out of date, providers may be misclassified, and bundled procedures may not show up as individual line items.
• Some prices are expressed as percentages of "billed charges" rather than dollar amounts. We label these clearly, but we cannot tell you what the resulting dollar amount will be.

4. Not advice

Information on PriceCheckMD is for general informational purposes only. It is not medical advice, not legal advice, not financial advice, and not a guarantee of price. Decisions about medical care should be made with a qualified healthcare provider. Decisions about billing disputes, insurance coverage, or financial obligations should be made with appropriate professional guidance where the stakes warrant it.

5. Acceptable use

You agree not to:

• Use the site to harass, defame, or harm any provider, insurer, or person.
• Attempt to circumvent rate limiting, scrape the site at high volume, or otherwise impose disproportionate load on our infrastructure. (If you have a legitimate research or commercial use case for bulk access, please contact us.)
• Misrepresent prices shown on the site as personal quotes from any specific provider or insurer.
• Use the site in violation of any applicable law.

6. Intellectual property

The underlying pricing data is published by insurers and hospitals pursuant to federal transparency requirements and is not our intellectual property. The structure of the site, the search interface, the cleaned and normalized database, and the written content on these pages are ours. You may use information you find through search for personal, research, or journalistic purposes. You may not bulk-copy our processed database without permission.

7. No warranty

The site is provided "as is" and "as available." We make no warranty that the data is accurate, complete, current, or fit for any particular purpose. We make no warranty that the site will be uninterrupted, secure, or error-free.

8. Limit of liability

To the maximum extent permitted by law, PriceCheckMD and its operators are not liable for any indirect, incidental, special, consequential, or exemplary damages arising from your use of the site, including any decisions you make about medical care, insurance, billing, or finances based on information found here.

If something goes wrong and we are nevertheless found liable, our total liability is limited to one hundred U.S. dollars.

9. Changes

We may update these terms as the site evolves. Material changes will be reflected here with an updated "last updated" date. Continued use of the site after a change constitutes acceptance of the updated terms.

10. Governing law

These terms are governed by the laws of the United States and the State of Idaho, without regard to conflicts of law principles.
